Terms of Service

1. Service Description
Victava is an AI-powered chargeback defense tool. Our platform automatically classifies disputes, gathers evidence from your connected payment processors, and drafts rebuttal responses. By default, nothing is submitted to Stripe until you review and approve it. You may optionally enable Auto-Pilot, in which case Victava submits approved evidence automatically within the limits you configure (for example a minimum win-likelihood and a maximum dispute amount). You can change those limits, or turn Auto-Pilot off, at any time.
1a. Stripe Today
Victava currently defends disputes on Stripe charges. We connect to your Shopify store, helpdesk, and carriers as data sources to strengthen that defense, but Victava is not a Shopify app and is not installed on or billed through Shopify. Support for additional payment processors, including Shopify Payments, is not offered today; we build new processor support on request for early customers.
2. Not Legal Advice
Victava is a software tool, not a law firm. Nothing provided by our service constitutes legal advice. The rebuttals, recommendations, and evidence compilations generated by Victava are produced by automated systems and should not be relied upon as legal counsel. You should consult a qualified attorney for legal matters related to chargebacks or disputes.
3. No Guaranteed Outcomes
While Victava is designed to improve your chargeback win rate, we do not guarantee any specific outcome for any dispute. Chargeback decisions are made by card networks and issuing banks, and are outside our control. Past performance does not guarantee future results.
4. Merchant Responsibilities
You are solely responsible for the accuracy of any evidence you manually provide or upload to Victava. While our system retrieves data directly from your connected integrations with full provenance tracking, any information you enter manually must be truthful and accurate. Submitting false or misleading evidence to dispute a legitimate chargeback may violate card network rules and applicable law.
5. Data Usage
We collect and process the following categories of data:
- Account data: Your name, email address, and business details provided during registration.
- Integration data: Transaction records, dispute details, customer information, and shipping data accessed through authorized OAuth connections to Stripe and other payment processors.
- Evidence materials: Documents, images, and text gathered or uploaded to support chargeback responses.
- Usage data: Service interaction logs used to improve the platform.
All sensitive credentials are stored in an encrypted vault. Data is encrypted in transit and strictly isolated to each customer's account. For full details, see our Privacy Policy.
6. Payment Terms
Victava charges a success fee only on disputes we win. There is no subscription and no monthly minimum. The standard fee is 20% of the amount recovered when a dispute is resolved in your favor; the first ten founding merchants lock in 10% for their first 12 months, after which the standard rate applies. If a dispute is lost, you owe $0. “Recovered” means the disputed amount Stripe returns to you when a dispute is won, and the fee is billed through Stripe only after the win is confirmed.
7. Termination and Cancellation
You may cancel your account at any time through your account settings or by contacting support. Because there is no subscription, cancellation simply disconnects the integration; any success fee already owed on a dispute won before cancellation remains payable. We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or abuse the service.
After account termination, we will retain your dispute data for a reasonable period to comply with legal obligations and resolve any pending disputes. You may request deletion of your data by contacting support.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Victava and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, loss of business, or loss of data, arising out of or related to your use of the service.
Our total aggregate liability for any claims arising from or related to the service shall not exceed the total amount you paid to Victava in the twelve (12) months preceding the claim.
Victava is not liable for chargeback outcomes, card network decisions, or any actions taken by payment processors, issuing banks, or cardholders.
9. Changes to These Terms
We may update these terms from time to time. If we make material changes, we will notify you by email or through a prominent notice within the service. Your continued use of Victava after changes become effective constitutes acceptance of the revised terms.
